Terms & Conditions

Please read all the terms and conditions below.

Make sure to register with Hibid.com prior to the start of auction so you will be able to bid.  This will be a timed online auction only.  We will have live previews usually 1 day prior to the actual auction.  You will be able to see and pre-bid on the auction approximately 5-7 days prior to auction.

By placing a bid on an item, that is a binding agreement that if you win the lot that you are agreeing to the terms and conditions of White Oak Auctions LLC which forms a contract of sale between the winning bidder and the auction.  All property at the auction is sold "as is" and all sales are final.  There are no refunds or bid reversals.  We encourage all potential bidders to preview items before bidding and contact us in advance with any questions.  White Oak Auctions is not to be held responsible for any omissions or errors.  Anyone who attends preview or picks up items assumes all risk if an item gets damaged while handling.  White Oak Auctions will not be held responsible for any damage or issues that arise during an auction or on the premises of the auction. Any injuries incurred will not be the responsibility of White Oak Auctions.  Please take care while on the premises.

Bidders must be 18 years of age or older.   We reserve the right to decline bidders for any reason. Hibid.com does require a credit card to verify the bid is legitimate.  We collect payments “in house” so we collect payment at the time of pick up or over the phone.  We take check, cash, credit/debit card (with 3% cc fee).  We will bill your card at the close of the auction unless you have previously arranged with White Oak Auctions LLC.  No exceptions.  White Oak Auctions LLC can revoke bidding at any time and for any reason should we feel there is fraudulent activity.

If an item doesn't match the description on the item, we will not be held responsible, however, please feel free to contact us and we will do our best to look into the situation and figure out what we can do.   We try our best to disclose any noticeable damage to items listed, but we will not be held responsible for any unseen and undisclosed issues. Again, all items are sold "as is" and all sales are final.

Once you win an item, it is to be picked up at our facility at the specified pickup time by appointment only after the auction.  We ask all winning bidders to contact us to schedule their appointment after the closure of the auction. You are solely responsible for removal of the items and packaging of the items, as well as confirming that you have received all of your items. You must bring your own packaging materials.  This includes dollies, carts, etc.  If you damage or lose an item while removing the item, White Oak Auctions LLC is not held responsible.  Items not picked up within the pickup times are considered abandoned and you forfeit the item.  If you can't make the pickup time please arrange for someone else to pick up the item on your behalf and let us know so we will release the item to that person.  If you do not show for pickup, your item is forfeited.  NO EXCEPTIONS!

We will have some shipping for small items available solely at the buyer's expense.  No furniture or rugs can be shipped.  By signing up as a buyer you also agree that White Oak Auctions LLC and the seller/consignor are not liable for any damage to the items you purchased, your personal property or for injury/death resulting from the purchase of that item.  Purchasers assume all liability resulting from the use of the item they purchased. White Oak Auctions is not responsible for any damage that any shipping company or USPS causes during shipping and the buyer assumes that risk.  We ask each winner for credit card information to ship items through these options as we do not use HiBid.com for shipping.  There is a 3% fee for credit cards.   If you do not provide this information, we can't ship the item, and therefore you forfeit the item at your expense.  No Exceptions!!

We reserve the right to remove or add items at any point during the auction.  Titles for special items will be dispersed on the day of the auction if the item its paid for in cash.  Otherwise they will have to wait 10 days for monies to clear our account.  Sales tax will be added to all items purchased.  If using a credit card to pay, there will be a 3 percent charge added to final bill.

Sellers' items, if not sold, must be picked up during the auction pickup times by appointment only unless another arrangement has been made.  If they are not picked up in a timely manner, they will forfeit their item. There is NO EXCEPTION.  Sellers/consignors will receive their funds from the auction within approximately two weeks from the date of the auction. We may contact you to pick up your check in person at our facility.  We want this auction to run smoothly and if you have any questions, suggestions, or concerns, please contact us immediately.

Chargebacks - As a condition to register and bidding, the buyer agrees that the buyer will not, under any circumstance, initiate a chargeback to the buyers credit card.  The buyer further agrees that the buyer is waiving any chargeback rights that may exist under the agreement between the buyer and the buyer's credit card company.  Should a chargeback be initiated by the buyer, these terms and conditions will be conclusive evidence of the buyer's waiver of any chargeback rights.
